TalentsForce Lifetime Deal – Terms & Conditions

These Terms and Conditions ("Terms") govern your purchase and use of the TalentsForce Lifetime Deal ("Lifetime Deal" or "LTD") provided by Freecracy Vietnam Co., LTD. (doing business as "TalentsForce," hereinafter referred to as "TalentsForce," "we," "us," or "our"). By purchasing or activating the Lifetime Deal, you ("Client," "Company," or "You") agree to be bound by these Terms.

1. Definition of "Lifetime"

For the purpose of this agreement, "Lifetime" refers to the lifetime of the TalentsForce product in its current form and business operation, as determined solely by TalentsForce. This is not the lifetime of the Client, the user, or any individual.

TalentsForce reserves the right to discontinue, replace, merge, or sunset the product at any time in the future, at its sole discretion.

2. Eligibility

2.1. This offer is available to registered companies only, including recruitment agencies and in-house recruitment teams.

2.2. You represent and warrant that you are an authorized representative of the Company with full authority to enter into this agreement.

3. License Grant

3.1. Upon successful one-time payment, TalentsForce grants you a non-exclusive, non-transferable, limited, lifetime license to access and use the TalentsForce platform for internal business purposes.

3.2. This Lifetime Deal is granted per user. Each user requires a separate Lifetime Deal license, unless otherwise specified in writing by TalentsForce.

3.3. The license may not be resold, shared, sublicensed, or transferred to another entity without prior written consent from TalentsForce.

4. Features Included

4.1. Your Lifetime Deal grants access to the specific features and resource limits of the selected plan (e.g., Professional or Agency) at the time of purchase. The definitive list of features for each plan is provided in the official TalentsForce Feature Matrix (the "Matrix"), which is incorporated by reference into this agreement.

4.2. Resource Limits Per License: Unless explicitly stated otherwise in the Matrix, all resource limits specified in your plan are applied on a per user license basis.

Example: If the selected plan includes "1,000 candidates storage" and the Client purchases 5 user licenses, the Client's total cumulative storage limit for the Tenant is 5,000 candidates (5 licenses x 1,000 candidates).

4.3. Core Features Package: The features included are based on the selected plan tier, and may include, but are not limited to:

A. Professional Plan Features:

  • Unlimited job openings
  • 1,000 candidates storage (Per User License)
  • Advanced careers page
  • Talent pools
  • Boolean search
  • Customizable hiring pipelines
  • Interview scheduling & Interview kits
  • Export jobs & candidates
  • Custom fields
  • Custom application form
  • Email templates
  • Recommendation engine

B. Agency Plan Features:

The Agency Plan includes all features of the Professional Plan plus features tailored for recruitment agencies, which may include, but are not limited to:

  • Profile templates
  • Company (Client company profile management)
  • Contact (Client contact management)
  • Placement (Placement tracking/monitoring features)

4.4. Excluded Modules and Features: Excluded from this Lifetime Deal are any current or future:

  • AI-based features (including but not limited to AI Parser, AI Writer)
  • Premium modules
  • Enterprise-only features
  • Add-ons, integrations, or third-party services not listed in the Matrix.

These may be offered separately under a new pricing model in the future.

5. Fair Usage Policy

5.1. Fair Usage Principle: Features designated as "Unlimited" (e.g., Unlimited job openings) are subject to this Fair Usage Policy (FUP). The FUP is designed to prevent abusive or excessive use of the service that may degrade platform performance or stability for other TalentsForce Clients.

5.2. Definition of Excessive Use: The Client's usage must remain consistent with that of a typical, similarly-sized Client in the recruitment industry. TalentsForce retains the sole right to determine what constitutes reasonable usage. Usage may be deemed excessive if it substantially exceeds the average usage of other Clients on the same plan or imposes a disproportionate load on the platform's infrastructure.

5.3. Enforcement and Remedies: If TalentsForce determines, at its sole discretion, that the Client's usage is excessive or abusive, TalentsForce reserves the right to take corrective action, including, but not limited to: temporary throttling, requiring the Client to upgrade to a standard subscription plan with defined usage limits, or suspension or termination of the account, as governed by the Termination clause.

No refund will be issued to the Client in the event of account suspension or permanent termination due to a violation of this Fair Usage Policy.

6. Updates and Changes

6.1. TalentsForce may, at its discretion, provide:

  • Bug fixes
  • Security updates
  • Minor feature improvements

6.2. Major product upgrades, new product lines, or premium versions are not guaranteed to be included in the Lifetime Deal.

7. Right to Modify or Discontinue the Offer

7.1. TalentsForce reserves the right to:

  • Adjust pricing
  • Modify terms
  • Pause or permanently stop the Lifetime Deal program at any time

7.2. Existing customers who have already purchased the Lifetime Deal will retain their access under these Terms.

8. Termination

8.1. TalentsForce may terminate your access if you:

  • Violate these Terms, including but not limited to any violation of the Fair Usage Policy (Section 5);
  • Misuse the platform; or
  • Breach applicable laws or regulations.

8.2. You may discontinue using the service at any time, however no refunds will be provided after activation of the Lifetime Deal.

9. Data Privacy & Security

9.1. TalentsForce is committed to protecting your data.

10. Limitation of Liability

To the maximum extent permitted by law, TalentsForce shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of the platform, even if advised of the possibility of such damages.

Total liability shall in no event exceed the one-time amount paid for the Lifetime Deal.
